You represent that you have the legal capacity to enter into this agreement on your own behalf or, where you act for another person or an organization, that you are authorized to bind that person or organization to these terms.

These terms apply to every visitor to the website and to every client or patient who engages the records administration services of BCV Peak Dental, LLC. Where a separate written agreement governs a specific service, that agreement controls to the extent of any conflict with these terms.

Description Of Services

BCV Peak Dental, LLC provides dental practice administration and records management services. These services include new patient charting and odontogram records, preventive cleaning and exam scheduling, restorative treatment planning, records requests and insurance coordination, emergency toothache triage and community outreach and school dental education. Our website describes these services and provides a way for people to contact our records desk.

We are an administrative office. We do not practice dentistry, we do not diagnose or treat any dental condition, and we do not prescribe medication. Clinical care is provided by licensed dental professionals who are solely responsible for the diagnosis and treatment of their patients. Our role is to maintain the records, calendars, plans and correspondence that support that clinical work.

The content on this website is provided for general information only. It is not dental advice, it is not a diagnosis and it must not be relied upon as a substitute for an examination by a licensed dental professional. Reading this website does not create a dentist patient relationship of any kind.

Our emergency triage service is an administrative scheduling function; it does not replace professional evaluation and it does not constitute medical advice.

You agree to provide accurate, current and complete information when you contact us, and to update that information when it changes, so that our records remain correct.

We may decline a request or ask for additional verification where we cannot confirm identity or authority, particularly for the release of records.

Handling Of Records

Where we administer records on behalf of a dental practice, we act at the direction of that practice and under the agreements that govern our engagement. Records requests are processed only after we confirm the identity and the authority of the requester. Certain records may be released only to the patient, to a person authorized by the patient or to a party entitled by law to receive them.

We maintain records in accordance with applicable law and professional standards. We may refuse a request that is incomplete, that we cannot verify, or that we are not permitted by law to fulfill. Where we refuse a request, we will explain the reason to the extent we are permitted to do so.

Electronic Records And System Access

Much of our records administration runs inside computer integrated dental systems that connect scheduling, charting, imaging references and billing into one coherent record. Where the practice grants you access to any part of that system, such as a patient portal or a records viewing function, that access is provided for your own use and must not be shared. You are responsible for keeping any credential you receive confidential and for reporting a suspected compromise without delay.

We may log access to our systems and review those logs to protect the integrity of the records we hold. We may suspend access to a system where we detect unusual activity, where a credential appears to have been shared, or where continued access would create a risk to the confidentiality or accuracy of a record. We will restore access once the concern has been resolved.

Where a paper chart and an electronic record describe the same patient, we keep the two synchronized so that neither drifts from the other. If you notice a discrepancy between a document you hold and the record shown to you, please tell our records desk so that we can investigate and correct it.

Insurance And Billing Matters

We coordinate with insurance carriers on behalf of the practice and its patients. We verify eligibility and benefits, assemble claim packets and track claims to acknowledgement. We do not guarantee that a carrier will pay a claim. Coverage decisions, benefit limits and reimbursement amounts are determined by the carrier and by the terms of the applicable policy.

Any estimate we provide regarding anticipated cost is an estimate only and may change if the clinical plan changes, if a carrier reconsiders a benefit or if additional treatment becomes necessary. The patient remains responsible for any amount not covered by insurance.

Scheduling And Cancellation

Our records desk schedules appointments and manages the recall calendar for the practice we support. When you schedule through us, we will confirm the appointment and record it in the chart. If you need to change or cancel an appointment, please give us as much notice as you reasonably can so that the slot can be offered to another patient.

Repeated failure to attend a scheduled appointment without notice may affect our ability to offer you preferred slots in the future. Any specific cancellation policy of the treating practice applies in addition to these terms.

Electronic Communication Consent

When you provide an email address or a telephone number, you consent to receive communications from us at that address or number for purposes related to your inquiry, your appointment or your records. These communications may include appointment confirmations, recall reminders, requests for additional information and notices about a records request. We keep these messages factual and we do not use them for unrelated marketing.

Standard message and data rates may apply to communications sent by telephone, and delivery is not guaranteed because it depends on carriers and networks outside our control. You may withdraw consent to non essential communications at any time by telling our records desk, and we will stop sending them. We may still send a communication where it is necessary to fulfill a request you have made or to comply with law.

Accessibility

We want the website and our services to be usable by as many people as possible. We design our pages with clear contrast, readable type sizes and structure that supports assistive technology, and we review the site periodically for accessibility problems. If you encounter a barrier that prevents you from using part of the website or from reaching our records desk, please tell us so that we can provide an alternative and improve the page.

Any amount that remains unpaid may result in suspension of administrative services. We will provide reasonable notice before suspending a service for non payment, except where the law or the circumstances require otherwise.

Third Party Services And Links

The website may reference or link to third party services and resources. Those services are governed by their own terms and privacy policies, and we are not responsible for their content, their availability or their practices. A reference to a third party does not imply endorsement.

Where we use a third party provider to operate part of our service, that provider is bound by a written agreement that limits its use of information and requires it to maintain appropriate safeguards. We review our providers on a regular cycle.

Disclaimer Of Warranties

Indemnification

You agree to indemnify and hold harmless BCV Peak Dental, LLC and its officers, employees and agents from any claim, liability, loss, damage, cost or expense, including reasonable legal fees, arising out of your use of the website or the services, your violation of these terms, or your violation of any right of a third party.

This obligation survives the termination of these terms and continues for as long as a claim may be brought. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with our defense.

Where such an event occurs, we will take reasonable steps to resume service and to protect the records in our care, and we will communicate with affected people as soon as we are able. The time for performance of an affected obligation is extended for the duration of the event.

Assignment And Waiver

You may not assign or transfer your rights under these terms without our prior written consent. We may assign our rights and obligations under these terms in connection with a merger, an acquisition, a reorganization or a sale of assets, provided that the assignee agrees to honor the commitments that apply to information we hold.

A failure by us to enforce a provision of these terms is not a waiver of that provision or of any other provision. A waiver is effective only if it is given in writing, and a waiver on one occasion does not waive the same provision on a later occasion.

Severability And Entire Agreement

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These terms, together with the Privacy Policy and any separate written agreement that governs a specific service, constitute the entire agreement between you and BCV Peak Dental, LLC regarding the website and the services, and supersede any prior or contemporaneous understanding on the same subject. A heading in these terms is provided for convenience only and does not affect interpretation.

Governing Law And Disputes

These terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these terms or to the services will be brought in the state or federal courts located in Utah, and you consent to the jurisdiction of those courts.

Before commencing formal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct discussion. Nothing in this section prevents either party from seeking urgent relief where it is necessary to protect a legal right or the safety of a person.

Changes To These Terms

We may revise these terms from time to time. When we make a material change, we will revise the date at the top of this page and, where appropriate, provide a more prominent notice. The revised terms take effect when posted.
